I Complaints regarding Products under warranty

1. The Seller undertakes to deliver the Product free from defects.
2. The Seller is liable to the Customer, who is a Consumer, for defects under the warranty on the terms specified in Articles 556 - 576 of the Civil Code. For Customers who are Entrepreneurs, the warranty is excluded.

3. Complaints arising from the infringement of Customer rights guaranteed by law or under these Regulations should be sent to ANNA SAMKOW Anna Samków Bagatela 10/26, 00-585 Warsaw, to the e-mail address: kontakt@annasamkow.com, phone number +48 604 090 963.

4. To consider a complaint, the Customer should send or deliver the advertised Product, attaching proof of purchase if possible. The Product should be delivered or sent to the address indicated in point 3.

5. The Seller undertakes to consider each complaint within 14 days.
6. In case of deficiencies in the complaint, the Seller will ask the Customer to complete it to the necessary extent immediately, but no later than within 7 days from the date of receiving the request by the Customer.

II Complaints regarding electronic services

1. The Customer may submit complaints to the Seller regarding the functioning of the Store and the use of the Services. Complaints can be submitted in writing to the address: ANNA SAMKOW Anna Samków, ul. Bagatela 10/26, 00-585 Warsaw, to the e-mail address: kontakt@annasamkow.com, phone number +48 604 090 963.

2. In the complaint, the Customer should provide their name, correspondence address, type and description of the problem.

3. The Seller undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Customer within this period when the complaint will be considered. In case of deficiencies in the complaint, the Seller will ask the Customer to complete it to the necessary extent within 7 days from the date of receiving the request by the Customer.

 

III Right to withdraw from the contract.

Instruction on withdrawal from the sales contract

We inform you that you have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day:

 

1. on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods or of the last of the goods if the contract covered the transfer of ownership of many goods delivered separately, or physical possession of the last lot or piece if the contract covered the transfer of ownership of goods delivered in lots or pieces,
2. on which a third party other than the carrier and indicated by you acquires physical possession of the goods or of the last of the goods if the contract covered the transfer of ownership of many goods delivered separately, or physical possession of the last lot or piece if the contract covered the transfer of ownership of goods delivered in lots or pieces.

 

To exercise the right of withdrawal, you must inform ANNA SAMKOW Anna Samków at ul. Bagatela 10/26,

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail).

You may use the model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal from the contract

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest, if the contract concerned the sale of goods.

If the contract concerned the purchase of goods, please send back or hand over the goods to ANNA SAMKOW Anna Samków at ul. Bagatela 10/26,

00-585 Warsaw or via InPost parcel locker WAW59M Puławska 2, Warsaw

without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

 

The Consumer's right to withdraw from the Agreement is excluded in the case of:

1. services, if the Seller has fully performed the service with the express consent of the Consumer, who was informed before the commencement of the service that after the performance of the service by the Seller, the Consumer will lose the right to withdraw from the Agreement;

1. An Agreement where the subject of the service is a non-prefabricated Product, manufactured according to the Consumer's specifications or serving to satisfy his individualized needs;
